Mr. Kracht represents companies doing business in the areas of resale, wholesale, distribution, construction and service, by providing legal counsel with regard to corporate formations, mergers, contract negotiations, preparation of distribution agreements, franchise agreements, employment agreements, non-compete agreement, confidentiality agreements, negotiation and drafting of commercial leases, and general corporate matters.
Through his Community Association Law practice, Mr. Kracht represents both home owner's and condominium owner's associations throughout Central Florida in all aspects of property management and governance. Specifically, Mr. Kracht's Community Association Law practice includes counsel regarding compliance with statutory obligations arising from Chapter 718 and Chapter 720, of the Florida Statutes, the drafting and interpretation of association governing documents, and when necessary litigating on the association's behalf in matters arising in the course of covenant enforcement and collections, including lien foreclosures.
Mr. Kracht has extensive experience assisting clients with both transactional and litigation matters relating to real estate law, including commercial and residential experience with sale / purchase transactions, foreclosure and eviction actions, landlord / tenant issues, leases and quiet title actions.
Mr. Kracht also litigates commercial matters; including, construction disputes, construction lien foreclosure, contract disputes, commercial property foreclosure and evictions, quiet title actions, and assists clients with post judgment collection efforts, discovery in aid of execution and garnishments.
Mr. Kracht also represents individuals regarding estate planning matters, including the administration of estates under the Florida Probate Code.
Mr. Kracht is a Florida native born in Miami and attended the University of North Carolina, Greensboro, where he earned his undergraduate degree. Mr. Kracht then attended, and graduated a semester early from, the Barry University, Dwayne O. Andreas School of Law. At Barry, Mr. Kracht was a member of the Moot Court Board, completed work as a certified legal intern with the Public Defender's Office of the Ninth Judicial Circuit, and an externship as a Certified County Court Mediator.
Mr. Kracht is a member of the Florida Bar and is admitted to practice before the United States District Court for the Middle District of Florida. Mr. Kracht served as a board member of the Winter Park, Code Enforcement Board.
